General terms and conditions of the contract between Dimona Suites and its users

INTRODUCTION

This document aims to regulate the general terms and conditions for contracting the ONLINE BOOKING services that are available to clients and users by the company Dimona Suites, with business address in Avenida Carlota Alessandri, 46, 29620 Torremolinos, Málaga, Spain, through its website www.dimonasuites.com (hereinafter “general terms and conditions of the Online Booking services”).

The following general terms and conditions have been established according to the good faith. If you wish to make an enquiry about the content, interpretation or modification of this contract, you can do so via e-mail at info@dimonasuites.com 
The conditions related to the main object of this contract, price and services offered or related to the services or goods provided in compensation for the price cannot be altered or modified.

The acceptance of the general terms and conditions of the Online Booking services will be completed by pressing the CONFIRM button. This assumes the full acceptance without any reservation of the general conditions published at the time of accepting the contract and making the booking. Therefore, users must read the conditions carefully since it is necessary their previous acceptance to complete it. 

Users have the obligation to use the Online Booking service in accordance with the current legislation and the general conditions of the contract. They also have to use it according to rules of public order, morals and good customs. Dimona Suites will deny access to its website if the user does not comply with the conditions.

PRIVACY POLICY

Dimona Suites guarantees the confidentiality of the personal data and complies with the Spanish legislation related to the protection of third parties’ personal data. Users agree, in accordance with the Spanish Organic Law 15/1999 of 13th December about Personal Data Protection and their subsequent regulations, that their personal details will be added to a file owned by Dimona Suites. This aims to process the requested booking and to offer personalised products and services, improving the relation with its clients. The user has the right to access, amend, cancel and refuse their personal data by sending an e-mail to info@dimonasuites.com 

Dimona Suites is not responsible for the possible errors or defaults of security that might happen if the user uses a non-secure or an out-of-date internet browser. Dimona Suites is not responsible for controlling and does not control the absence of a virus or elements in the content that might cause an alteration in the software or hardware of users or people visiting the pages of the website. Therefore, Dimona Suites is not responsible for the damages caused by these.

All the information contained in the website www.dimonasuites.com is protected by the rights of author and other rights related to intellectual property. The website belongs exclusively to Dimona Suites.

POLICY OF GUARANTEE, PAYMENTS, EARLY DEPARTURE, BOOKING CANCELLATION AND GROUPS 

Bookings must be guaranteed with a valid credit card.

Bookings can only be cancelled in written by fax or by e-mail or through the website. To be able to cancel your booking on www.dimonasuites.com you must keep your reference number, as you will need it to be able to access the booking within the established deadlines.

Cancelling a booking is free of charge if it is done up to 48 hours before the date of arrival, except package bookings (see package policy).
The cancellation of a booking can be done free of charge, if the cancellation is done at least 48 hours before the day of arrival, except from those bookings with other cancellation policy previously agreed for a package booking or special offer.
Early departures have to be communicated to the Reception giving a notice of at least one day. If the booking is cancelled after this time or in the case of not being present at Dimona Suites in the dates booked, Dimona Suites  is entitled to charge one night to the credit card given for the booking. The previously agreed price including taxes of one night will cover the cancellation costs and damages caused.

In the same way, Dimona Suites has the right to charge to the credit card provided in the booking any services or products consumed by the guest during his/her stay at the apartments, which were not paid at his/her departure.

Dimona Suites has the right to use the credit card provided as a guarantee of the booking to process its payment.

If the credit card provided is not valid, Dimona Suites  will cancel the booking automatically.

PACKAGES POLICY: BOOKINGS AND CANCELLATIONS

Cancellations of package bookings with a previously agreed and closed price are not allowed.

TO MODIFY RESERVATIONS

If you wish to modify your booking, you can do it directly at www.dimonasuites.com by introducing your booking reference, which was given to you at the time of confirming the booking. You can also contact us by calling this telephone number + 34 952 386 727. Once the booking has been modified, the services and conditions applied will be those included in the last modification.

If Dimona Suites cannot provide the contracted services in accordance with the agreed conditions, it is obliged to provide the user with accommodation in another place of similar characteristics as compensation for the damages caused.
Both parties agree to not claim any other quantity derived from the damages caused in the event of an anticipated cancellation by the user or due to the impossibility of Dimona Suites to provide the apartment and services contracted.

The prices of the services or offers included in the website will only be valid during the period of time that they are accessible to the user in the Online Booking system. 
Once the booking has been made through the online booking system and has been accepted by the user, he/she must print the booking confirmation, which is the proof of the contracted services and booking. In the event of not having the booking confirmation at the reception on arrival, Dimona Suites will not be responsible for any errors related to the booking. The booking confirmation includes all the necessary details of the booking, such as the arrival date, departure date, type of apartment and contracted services, number of people, the booking price and any other relevant information, by which the parties are bound.

The contract requests or other booking services not included in the Online Booking system will be made directly with their Dimona Suites by the user.

If one or various clauses included in the general conditions of the Online Booking system is declared partially or totally null or inefficient, this will affect only and exclusively the specific clause(s), leaving the remaining clauses under the same terms and with the same obligations.

The request of a cot or an extra bed is subject to availability. Dimona Suites will notify within a period of 24 hours if the request can be confirmed, including the extra cost, if any. Before the confirmation of availability of an additional cot or bed is completed, your booking confirms only the type of apartment chosen when making your reservation.
The request of additional services not included in the Online Reservation System will have to be discussed directly by the user with Dimona Suites.

APPLICABLE LAW AND COMPETENT JURISDICTION

The present terms and conditions are subject to the Spanish legislation. To resolve any disagreement in relation to the total or partial validity, execution, compliance or resolution of these terms and conditions, the user and Dimona Suites are subject only to the courts of the city of Málaga, Spain.

GENERAL CONTRACTING CONDITIONS OF THE ONLINE RESERVATION SERVICE

By accepting the present contract the user declares and accepts to have reached the legal age according to the current legislation of his/her nationality and to have full legal capacity to enter into this contract. He/she declares that he/she has understood the process of the Online Booking system and the Terms and Conditions of the Online Booking Service.

The user declares that all the data provided to Dimona Suites included those related to the information of the credit card to make the reservation are true, and that he/she acts for himself/herself and not on behalf of third parties.

The reservation will be confirmed and guaranteed with a VALID credit card, provided when making the reservation. The credit card information is necessary to guarantee the booking. However, the user authorises Dimona Suites to charge to the credit card provided any cancellation costs according to the terms and conditions of the Cancellation Policy.
